FIFA WORLD CUP AI PHOTO BOOTH ACTIVATION

Terms & Conditions：

This FIFA World Cup AI Photo Booth Activation (the “Activity”) is organised by adidas Hong Kong Limited (“adidas”, “we”, “us” or “our”), and operated by a third-party agency appointed by adidas (the “Agency”) acting on behalf of adidas.
The Activity will be available from 29 April 2026 to 28 May 2026, during the opening hours of the adidas THE FOREST store, unless amended, suspended or terminated by adidas at its sole discretion.
The Activity is conducted at the adidas THE FOREST store (the “Store”).
Each eligible participant may participate in the Activity once only during the Activity Period, unless otherwise determined by adidas in its sole discretion.
A participant who is:

(a)   a customer who purchases designated item at the Store,
shall be entitled to receive:
(i)   one (1) digital AI-generated photo; and
(ii)   one (1) printed photo.
A participant who is:
(a) a customer who didn’t purchases any item at the Store
may still participate in the Activity, but shall only be entitled to receive one (1) digital AI-generated photo and shall not be entitled to any printed photo.
adidas reserves the right to verify a participant’s eligibility for the relevant entitlement.
Printed photos are available while stocks, paper, printer capacity and operational conditions last.
Participation Process:

For customer who purchase designated item at the Store:
(a)   The customer must present the participation QR shown on the “Experiential Pass” to the QR code scanner at the photo booth;
(b)   select a photo frame;
(c)   take a photo using the photo booth;
(d)   permit the AI system to process the participant’s image and generate the output photo;
(e)   customise the generated photo with stickers or other available features;
(f)   scan the QR code displayed on the screen in order to receive the digital copy; and
(g)   receive one (1) printed copy at the same time, subject to availability.

For participants who are non purchasers at the Store:

(a)   select a photo frame;
(b)   take a photo using the photo booth;
(c)   permit the AI system to process the participant’s image and generate the output photo;
(d)   customise the generated photo with stickers or other available features; and
receive one (1) digital copy of the generated photo in accordance with the on-screen instructions
The digital copy will only remain available for download until 11:59 on the day the photo is taken.
The exact participation steps, user interface and fulfilment method may be adjusted by adidas or the Agency from time to time for operational reasons.
The Activity uses AI technology to process a participant’s captured image. The generated photo is intended for personal, non-commercial use only.
adidas does not guarantee that:

(a) the generated image will accurately reflect (i) the participant’s actual appearance, or (ii) the actual design, colour, texture, fit, materials, construction, branding, details or overall appearance of any adidas jersey or other adidas product; or
(b) the digital or printed output will be free from technical defects, delays or interruptions; or
Any AI‑generated visual depiction of an adidas jersey or other adidas product in the generated image is illustrative only, may be fictional, stylised or altered by AI processing, and shall not be regarded, relied upon or used as an accurate, complete or actual representation of any adidas product sold or made available by adidas.
adidas reserves the right to reject, cancel or remove any photo output that it reasonably considers to be unlawful, offensive, defamatory, infringing, inappropriate or inconsistent with the purpose of the Activity.
The collection, use, processing and handling of personal data in connection with the Activity shall be governed by the Personal Information Collection Statement made available by adidas at the photo booth.
By participating in the Activity, the participant acknowledges that he/she has read or has had the opportunity to read the applicable Personal Information Collection Statement and agrees to the terms therein.
Participants must not:

(a)   use the Activity for any unlawful, fraudulent, abusive or harmful purpose;
(b)   upload, create or generate any content that is obscene, indecent, offensive, discriminatory, defamatory, infringing or otherwise inappropriate; or
(c)   interfere with the operation, security or integrity of the photo booth, the AI system or any related equipment;
adidas may refuse, suspend or cancel any participation if it reasonably believes that a participant has breached these Terms and Conditions.
All intellectual property rights in and to the Activity, the photo booth system, software, frames, stickers, graphics, branding and related materials belong to adidas and/or its licensors.
Participants must not sell, license, exploit, publish for commercial gain, alter or use the generated photo in a misleading, unlawful or defamatory manner.
Participation in the Activity is subject to system availability, network connectivity, equipment functionality, staffing, supplies and store operations.
adidas may suspend, modify or discontinue the Activity or any aspect of it at any time without prior notice if required for operational, technical, legal, safety or other reasons.
To the fullest extent permitted by law, adidas shall not be liable for any loss, damage, cost or expense suffered or incurred by any participant arising out of or in connection with the Activity, any delay or inability to participate, any failure to receive a digital or printed photo, or any technical or system issue, except for liability which cannot be excluded by law.
Save for the participant’s rights (if any) in his/her name, image, likeness, appearance and personal data, all copyright and other intellectual property rights in and to any photo captured, generated or produced through the Activity shall belong to adidas.
In the event of any dispute arising from or in connection with the Activity, adidas’s decision shall be final and binding, to the extent permitted by applicable law.
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms and Conditions may be amended by adidas from time to time without prior notice. The latest version will be made available at the Store or by such other means as adidas may determine.
These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong, and the courts of Hong Kong shall have exclusive jurisdiction in relation to any dispute arising out of or in connection with the Activity.
In the event of any inconsistency or discrepancy between the English version and the Chinese version of these Terms and Conditions, the English version shall prevail.

PERSONAL INFORMATION COLLECTION STATEMENT

This Personal Information Collection Statement (“Statement”) applies to the collection, use and handling of personal data by adidas Hong Kong Limited (“adidas”, “we”, “us” or “our”) in connection with the adidas World Cup AI Photo Booth Activation (the “Activity”).

Data User

The data user in respect of the personal data collected through the Activity is adidas Hong Kong Limited.
Personal Data Collected
In connection with your participation in the Activity, adidas may collect and process the following personal data:
(a)   your image and facial photograph captured through the photo booth;
(b)   the AI-generated photo produced through the Activity;
(c)   if you are an adiClub member and/or a customer who purchased an item at the adidas THE FOREST store, information reasonably required to verify your eligibility for the relevant photo entitlement; and
(d)   technical, usage and transaction-related information generated in connection with your participation in the Activity.
Purposes of Collection and Use
Your personal data may be collected, used, processed and otherwise handled by adidas for the following purposes:
(a)   verifying your eligibility to participate in the Activity and to receive the applicable digital and/or printed photo entitlement;
(b)   enabling you to participate in the Activity;
(c)   capturing, processing, generating, customising, displaying and delivering your photo through the AI photo booth system;
(d)   printing your physical photo, where applicable;
(e)   administering, operating, maintaining, monitoring, troubleshooting and improving the Activity and related systems;
(f)   preventing misuse, fraud, abuse or technical disruption of the Activity; and
(g)   complying with applicable legal, regulatory, compliance and audit requirements.
Whether Provision of Personal Data is Mandatory
The provision of your personal data is voluntary. However, if you do not provide the personal data requested by adidas or permit the capture and processing of your image through the photo booth, adidas may not be able to allow you to participate in the Activity or provide you with the digital and/or printed photo.
Transferees
adidas may transfer or disclose your personal data to the following classes of persons, for the purposes set out in this Statement:
(a)   third-party technology vendors, photo booth operators, cloud service providers, fulfilment vendors and other service providers engaged by adidas to administer or support the Activity;
(b)   professional advisers, auditors and insurers of adidas; and
(c)   governmental, regulatory, law enforcement or other authorities where required or permitted by applicable law.
Use of AI Technology
The Activity uses AI-based image processing technology to process your captured image and generate your photo. By participating in the Activity, you acknowledge that your image will be processed through such AI system for the purposes described in this Statement.
Data Retention
Your personal data will be retained only for so long as is reasonably necessary to fulfil the purposes for which it was collected, unless a longer retention period is required or permitted by applicable law.
Access and Correction
You have the right to request access to and correction of your personal data held by adidas in accordance with the Personal Data (Privacy) Ordinance (Cap. 486).

adidas may charge a reasonable fee for complying with a data access request as permitted by applicable law.
Additional Information
If there is any inconsistency between this Statement and any other notice or communication relating to the Activity, this Statement shall prevail in relation to the collection, use and handling of personal data for the Activity.
